Compliance

Who needs to follow the rules — what about AI?

One of the challenges of my business is that technology often moves faster than our legal system. The flood of new AI systems is starting that cycle all over again.

I bet we'll all get plenty of calls, messages and videos from Hollywood and from politicians this election season, and I bet many of them will be made with AI tools. So be careful what you see and hear. Do some basic research. Verify!

What this has to do with outreach

What does this have to do with AcuCall and its customers? We're experts in using voice and text to find new prospects and customers for our clients' products and services, to reconnect with previous clients, to generate add-on sales, to collect outstanding fees, or simply to provide great inbound and outbound customer service.

We work with in-house customer lists and help clients build new lists of prospects' names and mobile numbers, then place automated contacts to them. Sometimes the goal is a human-to-human conversation. Sometimes it's collecting a payment automatically, and sometimes it's simply a notification. The process is the same: our outbound contact engine sends a message or a call to the name on the list.

Because we run on our own servers, we can place many calls at once and place new calls extremely quickly. In fact, we let our clients control the pace of those contacts, based on how many calls their staff can handle.

The rules your calls live under

The real issue our clients face is that the FTC, the FCC, numerous states and even some cities have laws that govern how those calls must be placed. For example:

  • a person must always be available to speak with;
  • recipients must be able to opt out of being contacted;
  • calls must be placed after 8am and before 9pm in the recipient's time zone;
  • any repeated call to that number is subject to a fine of $500 per call.

Healthcare adds another layer

We also serve a lot of clients in the healthcare industry. HIPAA is very strict about disclosing personal health information to other people, even family. So a simple voicemail like this one can land you in a lot of trouble, with significant fines:

"Steve, this is your pharmacy calling to say your prescription for Warfarin is ready."

Speak to us first

If you want to get more out of your customer and prospect lists, whether you're considering AI tools or simply text messages and voice calls, speak to me first. We spend a lot of time on our clients' behalf making sure their contact lists are scrubbed correctly, that they aren't over-dialing, and that privacy and do-not-contact laws are followed. The fines and legal issues can be considerable, and your CFO will thank you.
